The Federal Office for Food Safety (BAES) was established by the Health and Food Safety Act - GESG (Federal Law Gazette I No. 63/2002 as amended). The BAES is a subordinate agency of the Ministry of Agriculture(Federal Ministry of Agriculture, Forestry, Regions and Water Management). The Federal Office is affiliated to the Agency for Health and Food Safety GmbH(AGES). The Federal Office must use the resources of AGES to carry out its tasks.
Structure
In addition to the Director and his deputy in the operational area, the BAES consists of the two departments "Monitoring and Control" and "Legal Services, Licensing, Certification and Communication". The respective technical responsibilities can be found in the rules of procedure and the division of responsibilities.

Tasks
The Federal Office for Food Safety (BAES) is responsible for enforcing the following material laws in their current versions, including the related national legal provisions and European legal requirements, in accordance with Section 6 (1) of the Health and Food Safety Act (GESG):

- Section 3: Plant Variety Protection Act 2001 as amended

- Z 5: Plant Protection Act 2018 as amended

Independence, impartiality and integrity
In order to carry out these tasks, the BAES must appoint professionally qualified inspection bodies and issue them with a corresponding certificate of identification for this purpose. BAES employees are legally obliged to uphold the principles of independence, objectivity and impartiality in the performance of their duties.
Fees
For activities of the BAES in connection with the execution of sovereign tasks, a fee is to be paid in accordance with a tariff (§ 57 AVG), which is to be set annually with the approval of the Federal Minister of Finance to cover costs.
Official news
Pursuant to § 6 para. 7 GESG, the BAES must issue official notices and make these available to the public concerned in an appropriate form. In particular, the "Official Notices of the Federal Office for Food Safety" must announce
