As the competent authority, the Federal Office for Food Safety (BAES) can authorize companies to independently carry out conformity checks on the export of fresh fruit and vegetables.

In addition to the requirements set out in Article 4 of Regulation (EU) 2023/2430, all employees or authorized persons listed in the application must complete an e-learning course, which includes an on-site knowledge check. The necessary requirements are checked on site during an initial audit. The first three export controls after authorization is granted are carried out under the supervision of the BAES.

The BAES regularly monitors the authorized companies to ensure quality assurance and verify compliance with the legal requirements. Random checks are carried out according to a risk-based control plan, which, like the authorization itself, are subject to a fee in accordance with the BAES fee schedule. Authorization to carry out conformity checks independently is granted for at least one year.
